Answer:
It's nicer to have it on paper but a spoken agreement is enough. If they know how to perform the marriage and pronounce the words then no need for a religious authority. Witnesses are recommended but not required. Muta is only permissible with a virgin if she and her father both agree. A non-virgin woman (balegha) can make a contract on her own behalf.
